1. Acceptance of terms
By creating an account on KlikBee or using the service in any way, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service ("the Terms"). If you do not agree to these Terms, you must not use the service.
If you accept the Terms on behalf of a legal entity (company, organization), you represent that you have the necessary authority to bind that entity.
2. Description of the service
KlikBee is a modular SaaS platform for Canadian SMBs. The service includes, among other things:
- A CRM module (contact, organization, and deal management)
- Automations and workflows (import/export, third-party integrations)
- A smart assistant (AI) based on Anthropic's Claude technology
- Additional modules activatable à la carte
KlikBee may evolve, add, or remove features at any time. Substantial changes will be communicated by email to users.
3. User account
To use KlikBee, you must create an account. You are responsible:
- for the confidentiality of your password (minimum length 12 characters, mixed classes);
- for any activity performed from your account, except in cases of proven impersonation;
- for providing accurate information and keeping it up to date.
Multi-factor authentication (MFA): KlikBee strongly recommends enabling MFA for all accounts, particularly those with administrative privileges.
4. Payment
- Payment processor: payments are processed by Stripe Inc. KlikBee never stores credit card numbers.
- Currency: prices are in Canadian dollars (CAD), unless otherwise indicated.
- Taxes: applicable taxes (GST and QST for Quebec) are added to the displayed amount in accordance with Canadian tax law.
- Renewal: the subscription automatically renews at the end of each period (monthly or annual) until cancellation.
- Pro-rata refund:in the event of mid-period cancellation, KlikBee will calculate unused days pro rata and issue a credit (annual) or refund (at KlikBee's discretion).
- Payment failure: in case of repeated payment failures, KlikBee reserves the right to suspend access to the service after notification.
5. Acceptable use
You agree not to:
- send spam, unsolicited emails, or fraudulent messages;
- scrape, copy, or redistribute third-party data without proper authorization;
- enter, in free-text CRM fields, sensitive personal information that is not necessary (social insurance numbers, medical data, biometric data, etc.);
- use the service for illegal activities or activities contrary to public order or morality;
- attempt to bypass security measures, access other users' accounts, or disrupt the service;
- decompile, reverse engineer, or attempt to extract the source code of the service;
- resell or redistribute the service without written authorization from KlikBee.
KlikBee reserves the right to suspend or terminate an account in case of violation of this section, with or without notice depending on the severity.
6. Intellectual property
- KlikBee software: KlikBee remains the sole owner of all intellectual property rights in the software, interface, brand, modules, and documentation.
- Customer data: the customer (the SMB) remains owner of all data they import or enter into KlikBee (contacts, notes, files, configurations). KlikBee acquires no ownership rights in this data.
- License of use: KlikBee grants the customer a non-exclusive, non-transferable, and limited license to use the service for the duration of the subscription.
- Feedback and improvements: any suggestions or feedback you provide to KlikBee may be used freely to improve the product, without compensation.
7. Data and privacy
The processing of your personal information is governed by our Privacy Policy, which forms an integral part of these Terms. By accepting these Terms, you acknowledge that you have read the Privacy Policy.
8. Service availability
- Service level (SLA): KlikBee commits to reasonable best-effort to keep the service available. No 100% availability guarantee is offered.
- Maintenance windows: planned interventions may result in service downtime. They will be announced at least 48 hours in advance whenever possible.
- Exceptional interruptions: in case of emergency (security flaw, attack), KlikBee may interrupt the service without notice to protect users.
9. Limitation of liability
To the extent permitted by applicable law:
- KlikBee provides the service "as is" and "as available", without express or implied warranty beyond what is reasonable.
- KlikBee's total liability, regardless of cause, is capped at the amount paid by the customer for the service in the 12 months preceding the event giving rise to the claim.
- KlikBee is not liable for indirect or consequential damages, loss of profits, loss of data, or business interruption, except in cases of gross negligence or willful misconduct.
- Nothing in these Terms limits KlikBee's liability in cases of fraud, willful misrepresentation, or any other situation where the law prohibits limitation.
10. Termination
- By the user: you may terminate your account at any time from the KlikBee interface, with no exit fees.
- By KlikBee: KlikBee may terminate your account in case of violation of these Terms, after notice and formal demand remaining unaddressed for 15 days (except for serious cases justifying immediate termination).
- Data retention after termination: data is retained for 30 days after termination to allow recovery, then deleted irreversibly in accordance with the Privacy Policy.
- Export: you may export your data at any time from the interface, in a structured format (CSV/XLSX/JSON).
11. Modifications to the terms
KlikBee may modify these Terms at any time. Substantial changes will be notified by email at least 30 days before they take effect. Continued use of the service after this date constitutes acceptance of the new Terms.
12. Applicable law and jurisdiction
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein.
Any dispute relating to the interpretation or performance of these Terms shall be submitted to the exclusive jurisdiction of the courts of the judicial district of Montreal, unless otherwise required by mandatory provisions.
13. Force majeure
Neither party shall be liable for failure to fulfill its obligations resulting from a force majeure event (natural disaster, war, public infrastructure outage, governmental acts, etc.), provided that the affected party informs the other within a reasonable time.
14. Notification between parties
- To KlikBee: all notifications must be sent to bonjour@klikbee.ca, with postal copy to 5-910, chemin du Lac, Longueuil (Quebec) J4J 1W1.
- To the user: KlikBee will use the email address associated with the account for all official notifications.
15. DRAFT notice — to be validated by counsel
These Terms constitute a draft versiondrafted for preparatory purposes and have not yet been validated by legal counsel. They should not be considered legal advice. Before KlikBee's public launch, these Terms will undergo a full review by an attorney to ensure compliance with applicable laws in Quebec and Canada.
